dotPhoto Copyright Policy (July 12, 2004)
dotPhoto, Inc. (“dotPhoto”) respects the intellectual property, including the copyrights, of others, and expect that every dotPhoto user (“User”) will do the same. dotPhoto, in its sole discretion, may disable and/or terminate the accounts of users who dotPhoto reasonably believes may be infringing the intellectual property rights of others.
All photos, images, and content are copyrighted material and may not be used without the consent of the copyright owner. dotPhoto will promptly remove or block access to infringing or allegedly infringing material on its servers if dotPhoto becomes aware that such material infringes the copyright rights of a third party, whether dotPhoto identifies such infringement in the course of its ordinary and reasonable business activities, or through notification by a third party.
Users are solely responsible for the contents of their albums subject to the limitations set forth in dotPhoto’s Terms and Conditions and Privacy Policy. If any user believes that such content infringes a copyright, the User should contact the relevant album owner immediately in order to attempt to resolve the situation. If the parties are unable to resolve the situation, the User should promptly contact dotPhoto via mail, fax, or email using the contact information below.
If, in good faith, you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have otherwise been violated, please provide dotPhoto’s Copyright Agent with the following information:
  1. a description of the copyrighted work or other intellectual property that you claim has been infringed;
  2. a description of where the material you claim is infringing is located on the site, including the album name and the album owner’s user name, such user name being found in the upper right corner of the screen within the album in the “Guest of” field;
  3. a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright or intellectual property owner, its agent, or the law;
  4. an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;
  5. your address, telephone number, and email address; and
  6. a statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright or intellectual property owner or are authorized to act on the copyright or intellectual property owner’s behalf.
